Case filed against ex-district judge Masdar Hossain over cheating, criminal breach of trust

A case was filed on Thursday against former district judge and Supreme Court lawyer Masdar Hossain and two others on charges of cheating, criminal breach of trust and misappropriation.

The two other accused are Advocate Fathul Bari and Ashraful Islam, logistics manager of Nur Plastic Industries Ltd.

Md Jamal Hossain, an authorised representative of Nur Plastic Industries Ltd Chairman Nurul Islam Bepari, filed the case petition with the court of Dhaka Additional Chief Metropolitan Magistrate Md Sefatullah.

The complainant Md Jamal Hossain and his lawyer Belayet Hossain Molla confirmed the filing of the case.

The court recorded the complainant’s statement and directed the Criminal Investigation Department (CID) to investigate the allegations and submit a report, said Nasir Uddin, process server of the court concerned.

According to the case statement, the complainant alleged that Masdar Hossain, through the other two accused, took Tk1.10 crore from the company, promising to secure a favourable order in a VAT appeal and waive its tax penalty.

The complaint further alleged that the accused forced Nurul Islam to deposit Tk20.53 lakh in the government treasury to pursue the appeal, although the amount was supposed to be borne by the accused under their agreement.

It was also alleged that the accused later demanded Tk25 lakh for signing and handing over a certified copy of the zero-tax order after visiting the complainant’s office on 19 September last year.

When Nurul Islam refused to pay, the accused allegedly said they would not complete the work, according to the complaint.

Later, Nurul Islam learned through another lawyer that the VAT Appellate Tribunal had actually issued an order against the company on 6 August 2025, imposing a Tk42.09 lakh penalty.

He subsequently contacted the accused several times seeking a refund, but they allegedly refused to return the money.

The company alleged that the accused committed offences of cheating, criminal breach of trust, misappropriation and criminal intimidation.
