AD stays HC judgment on SC secretariat

The Appellate Division of the Supreme Court (SC) yesterday stayed the High Court judgment that had ordered to establish a separate secretariat for the Supreme Court (SC) within three months.
A four-member apex court bench headed by Chief Justice Zubayer Rahman Chowdhury passed the order after holding hearing on a state petition, pleading to stay the verdict.
The Appellate Division of the SC also set June 16 for holding hearing on the appeal file in this connec-tion.
Attorney General Barrister Md Ruhul Quddus Kazal moved the plea before the court, while Advocate Mohammad Shishir Manir argued for the writ petitioners.
Senior advocate Ahsanul Karim and advocate Karishma Jahan too stood for separate appellants.
The High Court (HC) on September 2, 2025, pronounced the judgment, directing the government to create a separate secretariat for the judiciary within the next three months.
A High Court division bench comprising Justice Ahmed Sohel and Justice Debasish Roy Chowdhury delivered the verdict, declaring absolute a rule issued earlier and striking down the amendment to Article 116 of the Constitution, thereby restoring its original (1972) provision.
The 185-page full text of the judgment was published on the Supreme Court website on April 7, 2026.
The state, however, on May 21, 2026, filed an appeal against the verdict.
