No legal bar to Ctgm-2 MP to perform

Staff Reporter:

Attorney General (AG) Md Ruhul Quddus Kazol yesterday said there is no legal bar to Chattogram-2 Member of Parliament (MP) Sarowar Alamgir performing his duties as a lawmaker.
The chief state counsel made the remarks after the Appellate Division earlier in the day removed a civil miscellaneous petition, from its cause list, filed by Bangladesh Jamaat-e-Islami candidate Muhammad Nurul Amin, who contested from the same constituency.
The Jamaat leader in the petition had challenged a High Court judgment that had upheld the nomination of BNP candidate Sarowar Alamgir for the Chattogram-2 seat.
“Following the High Court judgment, the Election Commission administered the oath to Sarowar Ala-mgir as a Member of Parliament, and he has since taken part in parliamentary proceedings.
However, the Jamaat-e-Islami candidate from the same constituency filed a civil miscellaneous petition (CMP) before the Appellate Division challenging the High Court verdict.
The Appellate Division heard the CMP over two days and had fixed Wednesday for passing its order.
Meanwhile, the full text of the High Court judgment was released yesterday. In this context, the Appel-late Division today ordered that the CMP be struck off the cause list,” the Attorney General said.
Kazol further added that the opposing party, however, may still file a regular civil petition for against the High Court judgment if it wants.
Advocate Mohammad Shishir Manir moved the plea for Muhammad Nurul Amin while senior lawyers Ahsanul Karim and Barrister AM Mahbub Uddin Khokon stood for Sarowar Alamgir.
Attorney General Md Ruhul Quddus Kazol argued for the state.
