The High Court (HC) yesterday issued a rule, asking authorities concerned to explain as to why it shall not declare illegal the legitimacy of death penalty in absence of a policy.
A High Court division bench of Justice Mustafa Zaman Islam and Justice Md Atabullah passed the order, also asking the authorities to explain as to why it shall pass order to formulate a clear policy in this regard.
The court came up with the order after holding hearing on a writ petition filed by Advocate Ishrat Hasan. The court asked the Law and Justice Division secretary and Supreme Court registrar general to reply the rule.
Advocate Ishrat Hasan filed the writ on December 6, 2023, and moved the case yesterday herself, while deputy attorney general Tushar Kanti Roy and assistant attorney general Selim Azad stood for the state.
