An Appellate Division bench of the Supreme Court (SC) yesterday dismissed the leave to appeal filed by Awami League nominee from Barishal-4 constituency Shammi Ahmed, for getting her candidacy back which was canceled by the Election Commission (EC).
A six-member apex court bench led by Chief Justice Obaidul Hasan passed the order this morning.
A separate order passed by Chamber court Judge M Enayetur Rahim stayed the High Court order declar-ing the Election Commission’s decision illegal regarding the cancellation of the candidature of Serniabat Sadiq Abdullah on the question of dual citizenship.
On December 15, the EC cancelled Shammi Ahmed’s and Abdullah’s candidacies on grounds of having dual citizenship, after applications were made by their opponents Pankaj Debnath and Zahid Faruk.
Shammi Ahmed filed a writ against the order which was scrapped by the High Court. Later, she made a leave to appeal with the Appellate Division.
On the other hand, HC passed an order in favor of Abdullah which was stayed by the chamber court.
